The Ministry of Economy and Finance eliminated the ambiguity of the tax law: the French do not need to tax their own consumption of solar energy - even rented or leased photovoltaic facilities. This clarification provides valuable certainty for renewable energy developers wishing to innovate business models.

An official document issued by French Customs authorities on 9 July clarified that French consumers were exempted from the internal tax of the final electricity consumption tax (TICFE).

Tax-free, 22.5 euros per megawatt-hour, largely determines the profitability of photovoltaic devices in private residential, commercial and industrial settings in France. Richard Loyen, general representative of Enerplan, the French Solar Energy Association, said, "When you produce 70-80 MW of solar power, TICFE is the decisive factor in the competitiveness of the project."

In his statement, Loyen explained that the exemption had been included in the Customs Act, but it was not clear whether solar consumers were not project owners. Now, even if solar installations are owned by third parties under lease or lease contracts, the clarification now officially exempts consumers from TICFE.

"The exemption of the French self-sufficiency consumption tax is good news for consumers," said Naomi Chevillard, policy adviser to SolarPower Europe, the European Photovoltaic Industry Alliance. "This is in line with the Clean Energy Plan, which stipulates that self-consumption should not be taxed and encourages new business models, such as self-consumption, aggregation and third-party investment."

Chevillard said Spain, Italy, Sweden and Austria are taking similar legislative measures, hoping that other countries will eventually follow the example of France.
